With the mature development of 5G,big data,cloud computing,deep learning,smart chips and other modules,the fourth generation of scientific and technological revolution with artificial intelligence technology as the core engine has started.Face recognition technology,in particular,plays a leading role in artificial intelligence technology,which has rapidly spread from the initial scientific experiment to government management,business and other fields.As face recognition technology goes deeper and deeper into our daily life,how to ensure that face recognition,a high-tech technology,promotes social progress and development,realizes public welfare value and private benefit value while avoiding the risks brought by it is a legal concern and response.The purpose of this paper is to deduce the risks and challenges brought by face recognition technology by analyzing the principle of face recognition technology,to show the defects of our current legislative regulation,to discuss the countermeasures in combination with foreign legislative models,and to put forward corresponding regulatory methods in combination with the reality of our country.In addition to the introduction,the text of this paper mainly includes three parts.The first part is an overview of face recognition,which introduces the concept,module composition,operation process,technical principle and development process of face recognition,summarizes the advantages of face recognition technology such as convenience,naturalness,non-intrusion and non-contact,and expounds the wide application value of face recognition technology in public and private fields such as criminal investigation and anti-smuggling,smart security,smart city,mobile payment and smart home,which brings great convenience to government public management and people’s daily life.The second part is about the risks of face recognition technology and the challenges it brings to China.Based on the characteristics of face recognition technology,it is deduced that the risks brought by face recognition technology include privacy freedom infringement,data security threat,poor accuracy,algorithm discrimination,data bias,etc.However,at present,China’s legal system is scattered in legislation,lacks special laws for special regulation,and has weak supervision in administrative law enforcement,showing a passive law enforcement situation.Judicial security is passive and inflexible,and lacks legal protection mechanism,which makes it difficult to effectively deal with the risks of face recognition technology.The third part is the reference of foreign legislative models and suggestions for regulation.By combing and summarizing the characteristics of foreign legal models and comparing with China’s Personal Information Protection Law(draft),it is discussed that separate regulation methods should be adopted to establish administrative examination and approval,administrative review,pre-test,manual review,data control,personnel training and other systems for government departments and administrative licensing,administrative supervision,evaluation and audit,data protection certification and enterprise self-discipline for non-governmental organizations.Good application and healthy and stable development of face recognition technology need to balance the interests of the government,non-governmental organizations and individuals,and pay attention to each of them,so as to build a legal system with multi-subject participation,multi-level supervision and all-round guarantee.On the one hand,it can ensure the development of face recognition technology and better serve the government management and enterprise development;on the other hand,it can safeguard the basic rights of the people and ensure that their rights are guaranteed while enjoying the convenience of science and technology.
