| In recent years,China’s motor vehicles have generally become an important tool for people to travel,and the increasing number of motor vehicle drivers year by year makes road traffic pressure huge,and road traffic accidents are frequently illegal.Since 2015,the number of traffic accident crimes has been on the rise,which not only brings great pressure to the road traffic safety and order of the whole society,but also brings great challenges to the road traffic supervision and traffic order maintenance of the public security and traffic police departments.In practice,the traffic accident is not only a traffic accident is a crime,especially in violation of traffic transport management regulations after the traffic accident escape behavior,is a serious infringement on the rights and interests of the victims increased the waste of judicial resources! Traffic hit-and-run crime does not agree with the general criminal crime,its characteristics are prominent,the scope of harm is strong,there is no causal relationship between the two parties,suspect screening workload is large and difficult.The daily business of the traffic police department of grassroots public security mainly centers on traffic order supervision and accident handling,and there are many aspects in criminal investigation and evidence collection.Found in judicial practice,part of the public security traffic management department in a hit-and-run crime investigation evidence collection in the scene of the accident protection does not reach the designated position,on-site technical level is not high,to obtain a single clue way,seizing pursuit mechanism is not sound,traditional investigative measures and poor technology application,at the same time hit-and-run crime related laws and regulations are not perfect,Some traffic police lags behind in the thinking of investigation and evidence collection in practical work,and their methods are not scientific enough,which makes it difficult and inefficient to solve such cases.However,it is found that the academic research on hit-and-run crime has always been focused on the regulation of criminal law,and few scholars have made in-depth research from the Angle of investigation and evidence collection of hit-and-run crime.The author will study the crime according to his professional learning and empirical analysis,combined with the actual work experience of the traffic police department in handling cases and specific cases,and then put forward reasonable suggestions to improve the investigation and evidence collection countermeasures of traffic hit-and-run crime.This thesis is divided into three parts.The introduction mainly puts forward the realistic background,necessity and specific research methods of the investigation and evidence collection of traffic hit-and-run crime,and puts forward the research direction and purpose.The text is the core content of the full text,which is divided into three chapters: The first chapter is an overview of traffic hit-and-run crime.This paper tries to explain the ontology "traffic hit-and-run" system,and defines the research scope of traffic hit-and-run from the perspective of legal provisions and judicial interpretation.The characteristics of hit-and-run crime are analyzed to provide useful reference for the following targeted measures.This paper expounds the harm of hit-and-run crime and points out the practical necessity and significance of the study.In combination with the judicial trial of specific cases,the time and space characteristics of the hit-and-run crime and the behavior characteristics of the escapers are analyzed in the data chart,which provides targeted empirical support for the study of the following investigation countermeasures.Chapter 2 regarding current hit-and-run crime in the judicial practice the existing problems and the focus of the investigation evidence collection,respectively from the laws and regulations,investigation evidence collection way,investigation of basic work mechanism,traditional measures and scientific methods were analyzed,and the deficiency of the cohesion and Angle in order to provide useful reference for investigation countermeasures.The third chapter,puts forward reasonable suggestions for the improvement of the existing investigation and evidence collection countermeasures of traffic hit-and-run crime,puts forward specific countermeasures and expounds the specific content.The conclusion part reviews and summarizes the whole paper and looks forward to the investigation and evidence collection of hit-and-run crime in the future. |
