Research On The Problem Of Private Copying In The Self-media Environmen

The development of science and technology drives the innovation of reproduction technology.With the high popularity of mobile information network and the progress of information technology,private reproduction in the self media environment presents new characteristics and new content,which constantly challenges the tolerance limit of copyright owners.If we continue to judge the legitimacy of private reproduction with the current fair use provisions,it will easily lead to excessive protection of private replicators,suppress the creative passion of copyright owners,and lead to the imbalance of interests between copyright owners and the public.Therefore,it is necessary to adjust the current fair use,improve the supporting system of copyright owner’s right protection,realize the effective regulation of private reproduction in the self media environment,and balance the interests between copyright owner and the public.This paper is mainly divided into four parts,including:The first part is an overview of private replication in the self media environment.This paper systematically discusses the concept of we media,the difference between we media and other media,the concept and characteristics of private reproduction,and finally expounds the disputes over the nature of private reproduction,and puts forward personal views and reasons.The second part is the current situation and problems of private reproduction in the self media environment,that is,combing the legislative status of private reproduction in the self media environment in China,and discussing the deficiencies of the regulation of private reproduction at the present stage.The third part is a comparative analysis of the extraterritorial legislative regulation of private reproduction,mainly including international conventions and the United States,Japan and Germany,and summarizes them,so as to provide experience for the legislative regulation of private reproduction in our country.The fourth part is the suggestions for the improvement of the private reproduction system in the self media environment.In view of the current dilemma of the regulation of private reproduction in the self media environment,it puts forward the measures to refine the reasonable use norms to improve operability,construct the compensation system to balance interests,establish and improve the digital rights management system,and improve the copyright collective management system,so as to realize the effective regulation of private reproduction in the self media environment.
