Research On Legal Issues Of International Cooperation In China's Ultra-high Voltage Direct Current Transmission Technolog

In recent years,the economic development and energy consumption of all countries in the world have increased rapidly,which has become a key factor and important force in the global energy transformation.Driven by the Belt and Road initiative,as a key factor and important force in global energy transformation,China’s UHVDC transmission project has carried out all-round,multi-level and wide area strategic cooperation in the global clean energy field,making important contributions to global energy transformation.Some countries have strong demand for power increment,and China’s UHVDC transmission technology has a strong development momentum,both providing great opportunities for international power cooperation.Power development in some countries is at a backward level due to technical and financial factors,and power grid construction needs to be strengthened.China’s cooperation with these countries can not only help them develop more electric energy,but also help them build a stable and efficient power supply and operation system in the long run.In recent years,China has attached great importance to cooperation with other countries in the field of power and energy,actively promoted international power cooperation,promoted large-scale transmission technology in a targeted and planned manner,and strive to organically combine the resource advantages and market advantages of all parties.However,due to the particularity of raw materials for power production and China’s completely independent intellectual property rights in UHVDC transmission technology,it is inevitable to face the problems related to patent rights in the process of international cooperation of UHVDC transmission technology.This paper first analyzes the possibility of international promotion of China’s UHVDC technology under environment of the Belt and Road.China’s continuous promotion of the Belt and Road Initiative provides the possibility and reality for the international promotion of China’s UHVDC transmission technology.This paper gives a detailed introduction to China’s UHVDC transmission technology and the current situation of relevant international cooperation,and analyzes the technical characteristics,optional cooperation modes and existing problems of China’s current UHVDC transmission technology.In order to improve China’s ability to deal with legal risks in international cooperation of UHVDC transmission technology and promote risk assessment rules,we will ensure the security of power supply and deepen the reform of power marketization,strengthen international power cooperation between China and other countries,and establish legal guarantee rules for international power cooperation security.However,there are still many legal problems to be considered in the international promotion and cooperation of China’s UHVDC transmission project.China’s UHVDC transmission technology is still facing severe challenges such as many uncertainties,high political risks and fierce international competition.Therefore,I put forward some legal problems that may exist in the international cooperation of UHVDC transmission technology in China,including the informalization of the rules of patent examination highway mechanism,the differentiation of patent examination highway rules,the instability of patent examination highway rules,the cumbersome cooperation mode,the fuzzy ownership of patent right,the difficulty in determining the patent transfer fee,the unclear concept and complex identification of necessity in international standard patent identification,and the difficulty of confirm the license rate under FRAND principle.Through the analysis and study of the problems found,I put forward my own views and suggestions from the aspects of perfecting the ownership of patent rights and the way of fee payment,perfecting the development strategy of patent examination highway in China,and perfecting the way of rate confirmation in standard essential patents.It is hoped that the legal thinking on the possible legal problems in the international cooperation of UHVDC transmission technology can provide a useful reference for enterprises,society and countries to improve energy cooperation and management.
