On The Civil Partial Judgment Of Our Country

Part of the judgment is a kind of judgment method clearly stipulated in Article156 of our Civil Procedure Law.It refers to the judgment made by the court for one of one or more of the subject matter of the lawsuit after trial and reaching the degree of judgment.Its earliest can be traced back to the late qing dynasty,although part of the judgment in our country,but because of its understanding is not comprehensive,law is more general,combined with the theoretical research is not in-depth,the lack of corresponding supporting measures,the part of the judicial practice is less and disorderly,as the applicable deviation from the legislative purpose and the rest of the errors.So that it failed to play its due value,even in an almost "dormant" state,but this does not represent that some judgments have lost the value of existence in today’s judicial practice.On the contrary,under the background of the normalization of epidemic prevention and control and the steady progress of judicial system reform,some judgment systems are precisely need to "show their talents".Through some judgments,the efficiency of litigation can be improved,and the rights and interests of the parties can be timely realized,so as to stabilize the social order.This paper takes the relevant provisions of some judgments in the Civil Procedure Law as the starting point,starts from the concept of some judgments,analyzes the origin of the system,nature and characteristics,as well as the development process of China,comprehensively understands the connotation,function and value of some judgments,and lays a theoretical foundation for the discussion of the later article.Secondly,based on the judgment of some judgments made by Jiangxi Province,we summarize the application status of some judgments in practice in China,and then analyze the existing problems,and combine the theory and practice to investigate the causes behind them.Finally,the specific idea of perfecting our partial judgment system is put forward.The relevant ideas mainly include:clarifying the applicable objects and conditions of part of the judgment,determining the scope of application of some judgment,fully protecting the litigation rights and interests of the parties and refining the operating procedures of part of the judgment.
