A Study On The Responsibility Mechanism Of The Operator Of The International Cargo Multimodal Transport Contract

With the acceleration of economic globalization,it is difficult for traditional transportation services to meet the development needs of today’s society.The international multimodal transport mode has attracted more and more countries’ attention and choice due to its huge advantages.At present,the United Nations Convention on International Multimodal Transport of Goods has been formulated internationally for multimodal transport,but it has not actually entered into force.Although the Convention has not actually entered into force,it has also played an important role in the unification and regulation of international multimodal transport of goods.The operator of the international multimodal transport contract,as the main body of the international multimodal transport,can better analyze and determine the liability problems of the damage,loss and delayed delivery of the goods in the international multimodal transport.At present,my country’s mechanism for international multimodal transport of goods is still relatively lacking and imperfect.There are conflicts in legislation and it is contrary to the general rules of international trade.The actual needs are not consistent.In response to the above problems,the article takes the responsibility mechanism of the operator of the international multimodal transport contract as the main research object.As the main research content,this paper attempts to analyze the current problems existing in my country’s international cargo multimodal transport contract operator mechanism through comparative research methods,and gives relevant suggestions on the construction of my country’s international cargo multimodal transport mechanism.The specific content of this article is mainly divided into the following four parts:the first part is to clarify the concept,It mainly includes the definition of the international cargo multimodal transport,the identification of the multimodal transport contract operator,the definition of between the international multimodal transport contract operator and other relevant parties,And the subject of responsibility,the form of responsibility,the compensation liability limit and other issues are expounded and analyzed;The second part mainly analyzes and analyzes the legislation of the international cargo multimodal transport contract operators and the four prevailing international conventions and the "China-Europe freight train";The third part is mainly based on the actual situation of China’s current international cargo multimodal transport contract operator mechanism,According to the practical requirements of the "China-Europe Freight Express" development initiative,This paper analyzes the relevant theory and practical experience of the current responsibility mechanism of international cargo multimodal transport contract operator in China,The reasons for the restriction on the development of China’s international cargo multimodal transport are summarized.On the basis of the above analysis,the choice of the responsibility mechanism of the international cargo multimodal transport contract is discussed,and the suggestions are put forward.
