With the economic development of the Internet as the lead of the new economy grows,more and more become the pillar of the national economy,modern logistics industry is the modern service industry,the origin of the role of consumption and economic growth,the development of modern logistics of these undoubtedly put forward higher requirements,rich connotation of logistics service,promote the efficient operation of market economy.Based on this background,the author found that in the logistics service industry,more and more consumers are trapped by the property damage caused by the defect of logistics service quality,which is ultimately the obstruction of the exercise of consumers’ right of claim.In daily life,the author and the surrounding people have been rejected by logistics enterprises for compensation,and also found that in judicial practice,many similar disputes concerning logistics services are not consistent.This paper expounds what kind of legal protection should be given to promote the normal and orderly exercise of consumers’ legal right of claim when consumers are harmed or involved in disputes in logistics service.This paper is divided into three parts besides preface and epilogue: the first part of the logistics service consumers claim legal protection,the essay discusses basic problems,analysis of the concept of logistics service consumers,the characteristics of logistics service consumers claim and the right content,finally discusses the logistics service consumer claims the necessity of legal protection;The second part analyzes the current legal system in our country for logistics service consumers claim the protection of the status quo,and analyze the consumer barriers,the right to claim from the exercise of difficulty for compensation for damage,standard term limits on the amount of the claim,defects of current dispute settlement mechanism,the three aspects to analyze the reason of difficulty of claim to exercise;The third part puts forward suggestions on improving the legal protection of logistics service consumers’ right of claim one by one. |
