Research On Legal Issues Of Medical Cosmetic Damage

With the improvement of life quality,people pay more attention to spiritual needs on the basis of basic food and clothing.The attention and acceptance of medical cosmetology services are generally increased,and the "beauty transformation" of their appearance can meet their spiritual and psychological needs.However,as an emerging industry,medical cosmetology has numerous loopholes in the application of laws and judicial judgment,leading to frequent occurrence of medical cosmetology disputes,even medical disputes and other malignant events,which makes the medical cosmetology industry with an increasingly high marketization level constantly exposed a large number of negative news.In the face of this situation,China urgently needs to clarify laws and regulations,improve relevant systems,and guide the healthy development of the industry.In the first chapter of this paper,the legal definition of medical cosmetology,discrimination and comparison with general medical behavior,and a brief overview of the legal nature of medical cosmetology damage disputes,the nature of its attribution,triggering the reality of medical cosmetology damage disputes thinking and attention.The second chapter sorted out the cases of medical beauty injury disputes from 2011 to 2021,and studied and analyzed the legal application,liability attribution principle,liability identification,damage compensation and other issues of disputes.In the third chapter,the author studies the legislation of relevant systems of medical cosmetic injury in foreign countries,and finds out what China needs to learn and draw lessons from by comparing the unique systems of several countries.In the fourth chapter,the author puts forward corresponding suggestions and countermeasures for the problems existing in the disputes of medical cosmetic injury.Our country can be clear on the law applicable to the liability for damage,unified imputation principle,perfect the liability for damage identification mechanism,clear compensation criteria and scope,adopts the system of insurance of medical cosmetic surgery,and so on,the future will also need to constantly sum up experience in dealing with disputes,continuously explore development,formed a set of laws and regulations to adapt to the situation of our country social system.
