With the continuous development of the short video market for films and televisions,more and more long-feature films and drama series are edited,cut,and pieced together by digital tools.This method of secondary creation,based on its low cost and low creation threshold,creates much shorter works than original ones.Small size,fast production and other characteristics are favored by social network users.Short video creators often use the original films and dramatic series works without the consent of the copyright owner of the original ones,which disputably results in frequent short video infringement.In order to protect the legitimate interests of the copyright owners of the original films and other drama series works from being infringed,and to ensure the healthy development of cultural undertakings,efforts must be made to solve the copyright problems of short video infringement.However,China’s regulations on the determination of infringement of short videos on the review of films and drama series are not perfect,and the relevant systems have not been able to comprehensively rectify the infringement phenomenon.Therefore,it is necessary to study on the infringement of short videos on the review of films and drama series and put forward the probable suggestions for it.This text firstly discusses the meaning and characteristics of short videos on the review of films and drama series,it is concluded that short videos on the review of films and drama series are derivative works of secondary creation.There is a clearer understanding of the legal nature of short videos on the review of films and drama series.By analyzing the infringement of short videos on the review of films and drama series and the reasons for their frequent occurrence,the author further discusses the infringement liability of short video creators for short videos on the review of films and drama series.Comparing with that three-step test method and the four-factor method,the paper proves that this kind of exploration of short video creators does not necessarily constitute fair use.According to the findings of the case study,online platforms play an important role in bearing tort liability in judicial practice,it analyzes the infringement determination of infringement of standards of online platforms,and demonstrates the reason why the safe harbor rule does not can be use as a defense.Finally,some suggestions are put forward for the frequent occurrence of the infringement of short videos on the review of films and drama series,to reduce the occurrence of such infringement disputes,and tofurther balance the interests of the copyright owner of the original ones,short video creators,and online platforms.
