Research On The Copyright Of Online Game Rules

In recent years,China’s game industry has been booming,and the revenue of gamerelated industries has been increasing year by year.Protection of the copyright of video games is conducive to the healthy development of the industry.However,due to the dichotomy of thought expression in the copyright law,the rules of electronic games have always been considered as thought and excluded from the protection scope of the copyright law.This kind of simple and crude characterization is not only bad for the protection of the first game,but also brings the wrong development signal to the game industry.Through a preliminary study on the Copyrights of electronic game rules,this paper explores the possibility of copyright protection,and summarizes the existing cases of game rules protection in the United States,and the enlightenment to the protection of game rules in China.This paper consists of four chapters.The first chapter is the debate about the copyright of electronic game rules.Firstly,it defines the rules of electronic games,divides them into basic rules,concrete rules and implicit rules,and discusses the possibility of becoming the object of copyright protection.Then it further discusses the handling of infringement cases of game rules in China and summarizes the dilemma of copyright of game rules.The second chapter further analyzes the elements of the copyright of game rules.Firstly,it analyzes the nature of the game rules as the object of copyright protection and the expression of the game rules that need to be protected.Then,the expression of game rules is analyzed with the example of "Defending the Turnip",and the novel plot thought expression pyramid is used for reference.Specific game rules constitute the expression of ideas: specific,detailed and clear game rules that can be perceived by the player’s operation and gameplay are specific game rules,which belong to the expression of game rules;Then it analyzes the other requirements for the copyright protection of game rules,and finally analyzes the factors that restrict the copyright protection of game rules.The third chapter analyzes the reasons for the protection of game rules through the case study of the infringement protection of game rules in the United States under extraterritorial law.The fourth chapter is the final chapter,retelling the rules of the game can protect the copyright,and analyze the factors that need to be considered in the recognition of infringement,and on this basis,put forward some suggestions for dealing with the infringement cases of the game rules in our country.
