Research On Famers’ Land Rights Development And Legal Safeguard Mechanism In The Process Of Urban-rural Integration

As the most important material for the survival and development of mankind,land is of great importance in any country and at any time.For the farmer,except for economic interests,the land also contains political rights,social rights and cultural rights.Land rights are the core of farmers’ rights,is also the fundamental embodiment of the interests of farmers.Since the founding of the PRC,China has always attached great importance to farmers’ land rights,we have established perfect land system by series of laws and policies.In the process of urban-rural Integration,there are many new problems and situations in rural land,farmers’ land rights have also been developed.In the process of urban-rural integration,grasping the development of farmers’ land rights and improving the rural land system are the inherent requirements of farmers’ rights protection and rural land system reform.This study is based on the contemporary era of urban-rural integration,using normative analysis method,empirical analysis method and comparative analysis method,based on the subject of law and learn from the multi-disciplinary theory of economics and other research.To protect farmers land rights,through the analysis of rural land system change and peasant land type in the process of urban-rural integration,exploring the development of farmers’ land rights.At the same time,based on the analysis of the influencing factors on the development of farmers ’land rights and farmers’ land rights protection system in typical countries abroad,bring forward the concrete measures to improve the legal guarantee system of farmers’ land rights development,and constructing the legal guarantee mechanism of farmer’s land rights according to the type of farmer’s land.This study is divided into eight chapters.The first chapter is the introductory part,including the purpose and meaning of the study,also include technical routes,innovation and so on.The second chapter is the theoretical foundation,which mainly elaborates the connotation of the concept of urban-rural integration,farmland land and farmers ’land rights and the mutual relationship between urban-rural integration and farmers’ land rights protection.Then the basic theory of this study is expounded,including the theory of law and the theory of economics.The third chapter is the analysis of the status quo,focusing on the land system changes and peasant land types from the two levels of farmers’ land rights of the development and problems,we can see that the property rights of farmers land is constantly strengthened.The fourth chapter is the analysis of the influencing factors,mainly through the qualitative analysis of the influencing factors of the farmers’ land rights,to explore the heavy and general rules of the development of the land rights and interests of the peasants,and lay the foundation for the follow-up countermeasures.The fifth chapter is the foreign reference part,through the United States,Japan and India,the farmers land rights protection system analysis,summed up the protection of land rights and interests of farmers in China’s three points of experience.The sixth chapter is the perfect part of the system,mainly from the principles to follow,improve the system and the legislative choice of three levels,the system of land rights and interests of farmers to improve the legal system.The seventh chapter is the construction of long-term mechanism,and tries to construct the long-term mechanism of legal protection of farmers’ land rights and interests from four aspects: risk prevention,benefit sharing,coordination promotion and ecological protection.The eighth chapter is the conclusion part,mainly elaborated the research main conclusion and the future research prospect.
