A Study On The Constitutional Approach To The Construction Of Human Community Of Shared Future

With the content of "promoting the construction of a community with a shared future for mankind" written in the twelfth preambular paragraph of China’s constitution in2018,the concept of a community with a shared future for mankind has become not only a diplomatic concept,but also an important part of the constitution.Compared with many theoretical research results produced in the field of political science,the law discipline has less research on the theory of the community of human destiny,and the research on this concept is mainly concentrated in international law.Therefore,in order to expand the research on the concept of the community of human destiny in the discipline of law,it is necessary to study the community of human destiny from the perspective of constitutional law.Firstly,the article discriminates the related concepts of the community of human destiny and expounds the related concepts of the community of human destiny,so as to achieve the goal of a comprehensive understanding of the concept of the community of human destiny and lay a theoretical foundation for the research of the article.Secondly,the article analyzes the necessity of studying the concept of the community of human destiny from the perspective of constitutional law,excavates the integration of the concept of the community of human destiny and constitutional law,and demonstrates the research value of this paper.Thirdly,the article explores and analyzes the difficulties existing in the process of promoting the construction of a community with a shared future,and summarizes that there are difficulties in the implementation of the normative effect of the preamble to the constitution,there are disputes over the relationship between domestic law and international law,western countries use the differences of civilizations to distort the purpose of the concept of a community with a shared future for mankind,the international community has not formed a constitutional consensus on the construction of a community with a shared future for mankind China’s foreign-related legal system is not perfect.Finally,in view of the above difficulties faced in the construction of a community of shared future for mankind: promoting the implementation of the normative effect of the preamble of the constitution,clarifying the status of international treaties in the constitution,interpreting the concept of the community of human destiny with the constitution as a tool,promoting the formation of constitutional consensus on the concept of the community of human destiny,and perfecting China’s foreign-related legal system based on the constitution.Use constitutional power to resolve the risks encountered in the construction of a community with a shared future for mankind and promote the construction of a community with a shared future for mankind.
