| Technological protection measures(TPMs)have been introduced into copyright law in order to protect the rights and interests of copyright owners.The protection of TPMs by copyright law strengthens the right owners′ control to their copyrighted works.However,the protection of technical measures in China’s Copyright Law has been disputable regarded is overwhelming.The provisions of TPMs in the Copyright Law amended in 2021 have been criticized that obscure text on the protection and lack of effective restrictions remain.Meanwhile,the strong protection of TPMs challenges the fair use of copyright.This will have a negative impact on the public interests.Therefore,it is necessary to re-examine the TPMs terms with the purpose to improve upon the protection of the public interests.On the base of analyzing the provisions,several problems in the application of this legal term can be discussed and paid more attention to.The suggestion of the paper is that the copyright law should restore the balance the conflict of the interests between copyright owners and the public that copyright law has tried to do by releasing the tense that the protection of TPMs might produce and allowing the public to circumvent TPMs outright for non-commercial use.In addition,copyright law should prevent copyright owner from abusing TPMs. |
