Research On The Legal Issues Of Rural Collective Economic Governance

Rural Collective Economic Organization is the product of Socialist Public Ownership,which is the main force in promoting the implementation of Rural Revitalization Strategy and deepening the Reform of Rural Economic System.At present,there are quite a number of Rural Collective Economic Organizations in our country,which do not give full play to their economic functions,so it is difficult to promote rural revitalization in substance.The state is actively promoting the investigation and drafting of the Law on Rural Collective Economic Organizations,and the first meeting of the leading group for drafting the law on rural collective economic organizations in2020 pointed out that it is necessary to guide the conditional local legislation in advance,and extract the relevant legislative basis from the practice of Rural Collective Economic Organizations.Based on the above background,this study will focus on the governance of Rural Collective Economic Organizations in rural revitalization.Starting from the perspective of the civil code and the Company Law,through interviews,data collection and other forms,using the methods of literature research,comparative analysis and empirical analysis,on the basis of clarifying the connotation and characteristics of rural collective economic organization governance,this thesis analyzes the legal basis of rural collective economic organization governance and the legal mode of rural collective economic organization governance.On this basis,taking Hongjiang district in Huaihua in Hunan province as an example,this thesis investigates and studies the existing listed rural collective economic organizations in this area,and analyzes the current situation of the governance of Rural Collective Economic Organizations in the form of fanning out from point to area,and points out the legal problems and causes in the aspects of the unclear ownership of property rights,the lack of the criteria for determining the membership of governance and the mixed organizational structure of governance.Thus it proposes the rural collective economic organization Governance Legal Construction: Using for reference the corporate governance model,and analyzing its advantages and conditions available.On the basis of giving full consideration to rural collective economic organizations as a special legal person,structuring the governance of rural collective economic organizations from the ownership of collective assets,the identification of collective membership to the organization and Operation Mechanism.In view of the fact that China is currently actively promoting the legislative work of rural collective economic organizations,the purpose of this research is to provide relevant suggestions for the legislative work,on the other hand,it also promotes the optimization of the governance of rural collective economic organizations towards the corporate governance model,so that its governance model can be innovated to better adapt to the development of rural collective economy,promote the implementation of rural revitalization strategy and the deepening of rural economic system reform.
