| In the context of national efforts to develop big data,the development of data market is very rapid,and China’s data transaction accounts for a large proportion of global transactions.However,due to the lag of law,a series of mixed phenomena occur in the data transaction market.The security risks of data transaction increasingly show the necessity of legal supervision.However,to realize the vigorous development of data trading,in practice,the industry security risk is increasing,and the violations of personal information and trade secrets are common,while civil laws are not enough to regulate this special trading behavior.Therefore,we must find a balance between data trading security and promoting data trading market through administrative law,so as to ensure data security and improve data utilization,It makes the social and economic benefits greater and greater.However,after the stage of large-scale and rapid expansion,the domestic big data trading market in the past two years has not achieved the expected market activity.Although all localities are actively establishing data trading centers and formulating industry rules for data trading,and data trading has also been showing an upward trend,it is obvious that today,with the development of data trading,the data trading volume that can be carried by the data trading platform is far from reaching the expectation,which is not only due to the lack of vitality of the data trading market,but also the chaos of legal regulation,which brings great confusion to the scope of responsibility of the data trading subject.In view of the current immature administrative legal system of data transaction in China,there are many loopholes in legislative policies,identification of administrative subjects,administrative subjects and administrative accountability procedures.Therefore,the first thing for the development of data transaction and data security in China is to promote the continuous improvement of administrative protection. |
