Research On The Liability Of Compensation For Enterprise Damage Caused By Workers’ Duty Behavior

With the development of economy and society and the improvement of enterprise’s awareness of safeguarding rights,the disputes over liability of compensation for enterprise damage caused by the duty behaviors of workers are increasing.The liability of compensation for enterprise damage caused by workers’ duty behavior refers to the the liability of compensation that workers should bear if they cause loss to the enterprise in the process of performing their duties.The focuses of controversy in such cases include whether the behavior of workers belongs to duty act and how to assume liability for compensation.At present,the legislative purpose of China’s labor law is inclined to protect workers.There are relatively many provisions on enterprise obligations,and there are few legal provisions on workers’ liability for compensation.It is also inconvenient to use in practice.Based on the analysis of the relevant cases of online disclosure of judicial documents in China,this thesis analyzes the conditions for workers to bear the liability for compensation and the grounds of exemption for workers’ damage to enterprise,and finds out relevant problems in judicial practice on the liability of compensation for enterprise damage caused by workers’ duty behavior.On this basis,it puts forward measures to improve the liability of compensation for enterprise damage caused by workers’ duty behavior,including standardizing the standard of workers’ duty behavior and the degree of fault,and clarifying the scope of workers’ compensation for enterprise damage,etc.Specifically,the research content of this article includes four parts: the first part gives the liability of compensation for enterprise damage caused by workers’ duty behavior an overview.The second part describes the current situation of the liability of compensation for enterprise damage caused by workers’ duty behavior.The third part discusses the experience and enlightenment of the liability of compensation for enterprise damage caused by workers’ duty behavior in Germany and Russia.The fourth part puts forward some suggestions on the improvement of the liability of compensation for enterprise damage caused by workers’ duty behavior.
