With the advent of the Internet era,the topic of cyberbullying has become the focus of public concern,which is more difficult to monitor cyberbullying and has greater social impact.However,China has not made systematic legislation to resolve the problem.Coupled with the multiple problems of online bullying in society and the harmful consequences brought to minors.Therefore,the governance of juvenile online bullying in China is imminent.The article tries to provide more feasible solutions,after introducing about the legislative and judicial status of the current minors online bullying of Chinese and other countries.In order to tackle further the prevention and treatment of practical problems of cyberbullying minors in our country,the essay will take more comprehensive comparison and analysis.This paper is divided into four parts.The first part gives a theoretical overview of juvenile cyberbullying behavior,including two aspects: the conceptual characteristics of behavior and the common manifestations of bullying behavior.By discussing the age definition of the subject of special protection is not uniform in China’s legislation,which is the current legislative status of juvenile cyberbullying in China,the second part analyzes the outstanding problems existing in the legal protection of juvenile cyberbullying in China.The tort liability sharing of cyber bullying in China is not clear.China’s legislation is not clear about the responsibility of Internet service providers,which should be further explained.The third part analyzes the legal regulation of overseas juvenile cyberbullying,and points out the significance of special legislation protection and collaborative supervision mode of government,society and enterprises for the prevention and control of current juvenile cyberbullying in China.In order to clarify the responsibility of cyberbullying violators,and pay attention to the legislative protection of cyberbullying victims,China will also actively learn from overseas excellent theories and practices.The fourth part,from the Angle of the practical significance,the paper will propose consummates our country legal regulation of the recommended minors online bullying behavior,unified network bullying the special protection of definition of the subject in the age,not only clear direct infringement liability of minors online bullying behavior,also emphatically discusses the network service providers tort liability.
