Research On The Legal Issues Of Intellectual Property Rights In The Transformation Of Scientific And Technological Achievements In Colleges And Universities

The transformation of scientific and technological achievements in colleges and universities is not only the way to realize the patent value,but also a sharp tool to promote the transformation of production mode and social progress.Therefore,it is regarded as the top priority in the top-level design of national strategy and intellectual property system.Due to the particularity of involving multiple subjects,the intersection of private rights and public welfare,complex process and long cycle,many intellectual property issues such as ownership,disputes and safety protection have been exposed in the transformation process of scientific and technological achievements in colleges and universities,which are all over the whole process of creation,application and protection,which is not conducive to the high-quality output of scientific and technological achievements in colleges and universities and inhibit the market-oriented trading of scientific and technological achievements,it even threatens national scientific and technological security.Based on this,we should reasonably learn from the foreign experience represented by the "Bayh Dole act" of the United States and the "Professor privilege" of Sweden to promote the systematic construction of the transformation of scientific and technological achievements in China’s colleges and universities.It includes but is not limited to coordinating the legal provisions of ownership to fully protect the right of transformation;build dispute resolution mechanism and improve transformation efficiency;establish national intellectual property security rules to prevent transformation risks.
