| Temperature warming is affecting the global ecosystem.In the central Arctic Ocean,the number of sea ice melting and disappearing due to temperature rise has doubled every year,greatly promoting the migration channel of fish to the north.Many factors lead to the complexity of the governance of Arctic fishery resources.The traditional methods of fishery development and management are not suitable for the fragile and sensitive Arctic ecosystem.In addition,for the current fishery resources in the Arctic high seas,there is no special legal system to carry out targeted management,and the existing regional fisheries management organizations can not cover all areas of the Arctic high seas.There is a huge gap in the legal protection in the Arctic.For a long time,Arctic countries have an absolute voice in the fisheries governance of the Arctic sea area,but the Arctic fisheries governance and even the governance of the Arctic sea area have never been a problem for one or even several countries.The integrity of the ecosystem and the sharing of rights and interests in the high seas all show that the conservation and development of the high seas fisheries in the Arctic need the joint participation of the international community.In addition to five Arctic countries,the ten Contracting States also include the EU and four stakeholder countries,resulting in the "A5 + 5" governance model.Although the agreement is only a legal framework and lacks some specific institutional arrangements,many preventive measures in the agreement lay the foundation for the follow-up scientific research and organization of the Arctic high seas.Firstly,starting with the current situation of fishery development and governance in the high seas of the Arctic,especially in the central and northern ice ocean.And summarizes the current governance characteristics and the plight of Fisheries Protection.Then it makes a critical analysis of the agreement from the aspects of joint scientific research plan,decision-making mechanism and access conditions.In addition,it also discusses the interaction between the CAOFA and BBNJ agreement.Finally,based on the governance mechanism formed by the agreement,this paper puts forward solutions for the protection of Arctic high seas fisheries from three aspects:improving the governance framework of the agreement,constructing Arctic high seas protected areas and strengthening international cooperation.At the same time,it earnestly analyzes the dilemma of China’s participation in Arctic fisheries governance,emphasizes the importance of China’s participation in Arctic affairs,especially fisheries governance,focuses on China’s Arctic strategy,and puts forward that under the principle of science and technology first,China should deeply study the international fishery legal system and frontier issues in Arctic waters,and respond to the queries of the international community with practical actions,While safeguarding China’s Arctic rights and interests,it also helps to protect the high seas fisheries resources of the Arctic. |
