As internet technologies such as artificial intelligence,blockchain,and cloud computing rapidly develop,data has become an important resource and production factor that connects global economic activities.However,with the globalization of data,countries around the world are also competing for control over data resources.The complexity of data flow through multiple channels,shared across various industries and stored in a distributed manner,increases the risk of information security.To mitigate risks,countries have established and improved regulations on cross-border data flows and participated in the formulation of international rules.Regulations such as the European Union’s General Data Protection Regulation and China’s Data Security Law provide strict provisions on cross-border data flow activities.In this context,domestic enterprises face challenges in complying with unclear and conflicting regulations,significantly increasing compliance costs and insufficient relief mechanisms.Enterprises need to comply with cross-border data regulations to avoid legal risks,ensure that they can continue to use relevant data legally,and promote sustainable development.This article will explore the compliance issues of domestic enterprises’ cross-border data flows in four parts.The first part introduces the overview of cross-border data flow and its compliance,including the concept,types,and judgment criteria of cross-border data flow,with a focus on the Didi Network security review case to analyze typical scenarios and risk sources of cross-border data flow.The second part introduces the regulatory environment and development trends of cross-border data flow compliance,analyzing the legal frameworks,standards,and practices of data protection in different countries and regions,and outlining the development trends of compliance.The third part introduces the compliance challenges faced by domestic enterprises in cross-border data flow.The fourth part proposes improvement suggestions for the compliance challenges mentioned above,including the establishment of a data security compliance community,attention to regional differences in regulations,building internal data compliance management systems,improving external data security mechanisms,perfecting post-protection relief mechanisms for cross-border data.
