The high-quality development of the economy requires optimizing the market structure,eliminating backward production capacity,and ultimately realizing the efficient allocation of resources,economic transformation and upgrading and healthy development.In optimizing the market structure,it is necessary to eliminate a group of enterprises that do not adapt to the development of the market economy.After an enterprise enters bankruptcy proceedings,the protection of employees’ rights and interests is a core issue.Wages are the basis for the survival of employees,as the consideration for the payment of labor by enterprises,and once an enterprise enters bankruptcy procedures,employees lose their source of income and basic protection.Since China’s social security system is not perfect enough to rescue employees of bankrupt enterprises,this will have an important impact on the basic life of employees.If the protection of employees’ claims cannot be effectively handled,it will bring huge hidden dangers to social stability and harmony.Employees create wealth for the enterprise and society to promote the development of enterprises and society by hard work,enterprises should also do a good job in the protection of the rights and interests of employees,especially in the face of bankruptcy to give priority to the protection of their creditors,China’s social security measures should also have a certain tilt to protect the interests of such groups,the government should also actively play a function to coordinate labor relations,protect the interests of employee groups.Based on the above considerations,the article will also describe three ways to realize employees’ claims.The paper is mainly divided into five parts,the first part is the introduction,which mainly includes the research background,current situation and research ideas of the paper;The second part mainly writes about the practice of employee claim protection,and this part mainly introduces and analyzes.through three typical cases;The third part specifically analyzes the difficulties existing in China’s protection of employees’ claims;The fourth part mainly writes how to resolve the dilemma of employee claim protection,combined with the practice at home and abroad,mainly puts forward three solutions:establish a priority protection system for employee claims,establish a wage arrears protection fund system,and establish a normalized government-court linkage mechanism;The fifth part is the conclusion,mainly writing about the application of the three paths mentioned above in practice,and analyzing and pointing out the shortcomings of the research in this paper and the future research direction,in order to improve the protection of the claims of employees of bankrupt enterprises in China.
