Drug-related crimes do great harm to the social order and human’s mental health,causing many social contradictions.For a long time,fighting drug-related crimes is the most important in our country.The way of drug spreading is becoming more and more hidden.The drug purchasing agent makes it more difficult to crack down on drug crimes,and the related problems emerge in the judicial practice.At present,there are some problems in the application of law,such as the concept is not clear,the nature of the behavior is not complete,the subjective motivation is still controversial.As for“Drug purchasing behavior”,which is a typical drug crime,the drug purchasing behavior is complex and varied,and the concept of criminal code and related judicial interpretation in legislation is ambiguous,at present,there are four minutes of the meeting,a“Prosecution standards(3)”,a guide to the decision as a normative document.At present,there are divergent views in the judicial and practical sectors when determining the nature of drug procurement.There are still cases of different judgments in different judiciary.The identification of the nature of drug procurement has long been controversial,there are mainly the following points of view: innocence,drug trafficking and illegal possession of drugs and drug trafficking crime.In this paper,the main analysis of the case whether the parties constitute a crime,such as the establishment of a crime,should be identified as drug trafficking or illegal possession of drugs crime.First of all,this paper introduces a case,summarizes the details of the case,lists the facts of the drug agent’s behavior,puts forward the dispute focus and the application of the charges of the dispute.Secondly,the concept and characteristics of drug purchasing behavior,the classification of drug purchasing behavior,and the theory of what kind of legal interests the drug purchasing behavior infringes are discussed.Thirdly,it puts forward the views of different behaviors,different purposes and how to make profits of the agent buyer,and discusses the differences of the applicable charges in this case according to different theories,this paper analyzes whether the Acts of drug purchasing agents constitute crimes and whether they constitute crimes of drug trafficking or illegal possession of drugs.Finally,the author puts forward the author’s opinion about the criterion and the applicable situation of the discrimination of charges.
