Research On Improving The System For Filing And Reviewing Party Laws And Regulations

As an important link in the construction of intra-party laws and regulations,the examination and filing of intra-party regulations plays an irreplaceable role in promoting the high-quality development of intra-party laws and regulations.The CPC Central Committee has attached great importance to optimizing and improving of the party regulations filing and review system against the background of comprehensively governing the Party with strict discipline since the 18th CPC National Congress.Although the CPC Provisions on the Filing and Review of Intra-party Regulations and Normative Documents in 2019 have comprehensively revised the filing and review of intra-party regulations,there is still room for futher discussion in the theoretical and practical aspects.In this paper,how to promote the optimization and improvement of the party regulations for the record review system,based on the development of the party regulation system,from the perspective of comparative analysis,the rules and the differences and the law of the party record censorship,analyze the problems existing in the censorship system of the party regulations,and improve the pertinence of the party regulations record censorship system.In short,guided by the basic theories such as power supervision,governing the Party in accordance with regulations and the unification of the legal system,the improvement of the system for filing and reviewing party regulations plays an important field for the organic unity of the rule of law and the Party in accordance with regulations.From the perspective of coordination,mutual guarantee and mutual reference of party rules and state laws,it is necessary and feasible to compare and analyze the party rules and state laws record and review system.Through the comparative study of the historical development and the system elements,it is found that the following problems exist in the operation of the system:firstly,from the perspective of the subject;secondly,in the review process,the implementation of the regulations of passive review and the review criteria are not detailed enough and are not really implemented in the actual work.Finally,the record review procedure is not smooth,including the operation procedures,supervision and accountability and other supporting mechanisms still need to be improved.Based on the current problems,the useful experience of the national legal filing and review system starts from three aspects,one by one,so as to provide reference for responding to and solving the prominent problems and the practical needs of the filing and review system of the party regulations in concrete practice.First of all,a working committee responsible for the filing and review of party regulations to improve the capacity building of the subject in submission and review.Secondly,enhance the filing and review through setting up a standard procedure for submission and reviewing of passive review and begining the method and optimize the joint meeting.Finally,by clarifying the provisions of the filing and review procedures,granting the right to object,and improving the accountability and review and supervision mechanism,the filing and review procedures can be unblocked.In this way to achieve the party laws and regulations of the comprehensive supervision and regulation.
