Criminal Law Protection Of Network Virtual Property

With the vigorous development of the Network information age,a large number of Internet virtual properties exist in different cyberspace and are endowed with different functional values,and related disputes are becoming increasingly fierce.However,because the connotation and extension of Internet virtual property have a considerable degree of complexity and uncertainty,so the study of network virtual property must think in terms of types.By using research methods such as survey method,literature reading method and type analysis method,this paper innovatively divides various forms of Internet virtual properties into three different types:virtual props,network accounts,network domain names and shops.This paper aims to analyze the legal nature of Internet virtual property in different space scenarios.And by summarizing and sorting out the common infringement behaviors of different types of Internet virtual properties,combined with the constitutive elements of criminal charges and protection benefits,try to analyze and extract a more feasible path of criminal law protection of Internet virtual property.In short,the virtual property of virtual props should be identified as property interests,and the related criminal acts should be evaluated and identified as property crimes.The virtual property of accounts should be identified as citizens’ personal information,and the related criminal acts can be evaluated through the crime of infringing citizens’personal information and the crime of helping information network activities.Network domain names and virtual property of shops should be identified as public and private property,which can be evaluated through the crime of false advertising,crime of damaging commercial reputation,crime of damaging production and management.
