Research On Legal Issues Of Public Enterprise Information Disclosure

With the development of public enterprises in China,the public’s demand for public enterprise information disclosure is increasing.However,the current level of public enterprise information disclosure in China is far from meeting the urgent needs of the public.Therefore,in recent years,the number of lawsuits against public enterprises such as transportation,communication,water supply,power supply,and heating for information disclosure has increased year by year.However,these information disclosure demands are often due to insufficient legal basis,lack of relief procedures,and other reasons,Without a systematic solution,the final information disclosure results are often unsatisfactory.The reason for this is that although there are practical factors such as difficulty in litigation and rights protection,the biggest sticking point is still the lack of relevant laws and regulations on public enterprise information disclosure.Therefore,it is still of practical significance to further explore,research,and improve the solutions to the many problems that arise in actual performance of public enterprise information disclosure.This paper aims to compare and sort out the content of public enterprise information disclosure in the two different versions of the "Regulations on Government Information Disclosure" formulated in 2007 and revised in 2019.At the same time,combined with the"Measures for the Formulation of Information Disclosure Regulations for Public Enterprises and Public Institutions" and other laws and regulations issued by the General Office of the State Council,this paper analyzes the legal issues of public enterprise information disclosure in China from the aspects of subject,scope,methods and procedures,supervision and relief,And propose improvement suggestions.Specifically,this paper mainly focuses on the following aspects:firstly,it clarifies the basic meaning and particularity of public enterprises,and then explores the necessity of public enterprise information disclosure,providing theoretical support.Subsequently,by comparing the content of public enterprise information disclosure in the new and old versions of the "Regulations on Government Information Disclosure",the "Measures for the Formulation of Information Disclosure Regulations for Public Enterprises and Institutions",and relevant ministerial documents,the legal issues that constrain the development of public enterprise information disclosure work in China were identified through analysis of the main body,scope,methods and procedures,supervision and relief,and other aspects.Mainly including incomplete information disclosure system,inconsistent implementation standards for information disclosure scope,absence of information disclosure methods based on application,and insufficient supervision and relief capabilities for information disclosure.Subsequently,an analysis and reference were conducted on the legal systems of public enterprise information disclosure in the United States,Japan,and other countries and regions,identifying some institutional designs and measures suitable for China’s national conditions in foreign countries to address legal issues related to public enterprise information disclosure,and using them for reference.Finally,based on the experience and suggestions summarized in the previous text,combined with my own reflections,I have put forward some suggestions for improving the information disclosure system of public enterprises in China from several aspects such as legislation,supervision,and relief.I hope to explore a system design suitable for China’s national conditions,which can be beneficial for improving the information disclosure of public enterprises in China.
