| Party regulations and national laws are both laws of great significance in the context of the era of construction of the socialist rule of law system with Chinese characteristics,and both of them realize the adjustment of social relations in specific fields through specific behavioral norms,which have strong practicality.The Decision of the Central Committee of the Communist Party of China on Several Issues Concerning the Strengthening of Party Construction under the New Situation,adopted at the Fourth Plenary Session of the 18 th CPC Central Committee,takes the improvement and perfection of the Party’s internal regulations system as an important element of the strategy to promote the rule of law,which has distinctive features of the times and practical significance.There exists a harmonious path of benign interaction between Party regulations and national laws,which is an indispensable and important part of the national governance system and governance capacity building,and both of them have a certain degree of fit in value pursuit,fact integration and implementation specification.At present,China has initially formed a complete and unified system of Party regulations with the Constitution of the Communist Party of China as the mainstay and the relevant individual laws and regulations as the components.The parallel,intersecting and overlapping relationships exhibited by party regulations and national laws are one of the important reasons for the lagging construction of the party regulations’ own system,which also affects the communication mechanism and stage measures between party regulations and national laws.In this paper,through investigation and analysis,we propose the principles of convergence and articulation between party regulations and national laws,and try to construct the basic principles of convergence and coordination between party regulations and national laws as an entry point,focusing on internally improving the top-level design of party regulations system construction and strengthening the filing and review mechanism to improve the level of specialization,and externally improving the coordination mechanism to construct the coordination mechanism of convergence and coordination with national laws to achieve both The Party should focus on improving the internal design of the Party’s regulatory system and strengthening the filing and review mechanism to enhance professionalism,and improving the external coordination mechanism to construct a coordination mechanism with the national law to achieve the convergence and coordination of the two "seeking common ground while reserving differences" values. |
