In the era of data economy,countries all over the world are vying for the right to speak in the field of data,in order to occupy an advantageous position in the new round of digital revolution and enhance international influence.In July 2020,the European Court of Justice finally invalidated the Privacy Shield Agreement,which not only brought shocks to the digital economic and trade relations between the US and Europe,but also had a profound impact on the overall pattern of the world digital economy.Behind the breakdown of the cross-border data flow cooperation agreement between the US and Europe is the huge difference in the data privacy protection model of the US and Europe,and the practice of the slogan of recapturing "technological sovereignty".The arrival of the post-"Privacy Shield Agreement" era has not only brought challenges to the developing countries led by China,but also brought opportunities.Therefore,this article by clarifying the us and the cross-border data flow cooperation policy changes and the reason,mainly analyze the privacy shield agreement invalid judgment the legal issues,and the privacy shield agreement invalid,the two sides respectively adopted what measures,and explore the cause of the cross-border data flow cooperation rupture and the us and European game has a profound impact on the global digital economy pattern.Further more,in the context of the game between the US and EU,China should develop a data protection legal system in line with the international situation and China’s national conditions,and proactively respond to the trend of cross-border personal data flows,improve the cross-border data compliance of Chinese enterprises,and participate in global data governance,so as to enhance China’s voice and international influence in the international data field.
