Study On The Accredited Agency Reform And Problems Of Grassroots Discipline Inspection And Supervision From The Perspective Of Tiao-kuai Relation

In March 2018,The Supervision Law of the People’s Republic of China was promulgated and implemented,and the National Supervisory Commission of the People’s Republic of China was inaugurated,that marked an important achievement in the Reform of the National Supervision System which was an overarching and far-reaching major political reform.From there,anti-corruption work has entered a new stage of legalization and institutionalization.In order to deepen the Reform of the National Supervision System and achieve full coverage of Inner-party Supervision and National Supervision,local governments follow the arrangements and requirements of the central government to carry out the Accredited Agency Reform of Discipline Inspection and Supervision successively,trying to improve the quality and effectiveness of the supervision by accredited agency.In May 2019,Q District of Shanghai officially implemented the Accredited Agency Reform of Discipline Inspection and Supervision.Since the reform,the accredited agency of Q District has given full play to authority and superiority,conscientiously performed the two functions of discipline inspection and supervision,strengthened the supervision,the discipline and the law enforcement productively,that effectively promote the high-quality development of discipline inspection and supervision in Q District.This thesis takes Q District of Shanghai as an example to study on the Accredited Agency Reform for Grassroots Discipline Inspection and Supervision,which aims to tease reform process,summary reform results,analyze problems and give opinions,in order to optimize the Accredited Agency Reform for Grassroots Discipline Inspection and Supervision,enrich correlative theories as Inner-party Supervision,and make a contribution to driving the academic research on anti-corruption going deeper.First of all,this thesis expounds the meaning of the Accredited Agency Reform,which is the important content of improve the supervision system of the Party and State,and the object requirement of modernizing China’s system and capacity for governance.Meanwhile,it studies the process of the Accredited Agency Reform of Discipline Inspection and Supervision,which is divided into three phases: exploring,unified management and full coverage,and summarizes the current running state of the Accredited Agency as five aspects: improving the system,defining responsibilities,strengthening independence and authority,enriching supervision means and basically realizing full coverage of supervision.Then,this thesis takes the Accredited Agency Reform of Discipline Inspection and Supervision of Q District as an example to carry out the research,and discovers the essence of reform,which changes the supervision pattern of the Party and State organs at district level.On the basis of sketching reform process,institution setting and exercise of power,this thesis uses the Intergovernmental Relations Theory and the Inner-party Supervision Theory from the perspective of Tiao-kuai Relation to analyze the changes brought by the reform and come to a conclusion,that supervision is transformed from consubstantiality to variant,decentralized to unified,resulting to procedural and Tiao-kuai Interaction is transformed primary from conspiracy to confrontation.In the meantime,from improving supervision quality,discipline and law enforcement and the work efficiency three aspects,it expounds the achievements on the reform with correlative cases and data.Subsequently,from the perspective of Tiao-kuai Relation,this thesis deeply analyzes a series of problems which appear in the Accredited Agency Reform of Q District by using the Intergovernmental Relations Theory and the Inner-party Supervision Theory,and demonstrates and presents the above mentioned by concrete cases,interviews and correlative data.For example,the Stationed Department as the subordinate Kuai-kuai uses the low profile resistance techniques,namely,weapons of weak such as policy flexibility,deliberate delay,withholding information and prevarication,to dissolve the pressure from the representative of superior Tiao-tiao(the Accredited Agency)and resist its supervision,which causes Tiao-kuai confrontation and influence the effect of supervision.For another example,both side of Tiao-kuai engage in a game of interest,or they work together to deal with the task and inspection of the superior,which is likely to cause Tiao-kuai conspiracy and adverse effect.In addition,there are problems such as the double marginalization of the Accredited Agency cadres,inadequate and misallocated power of the supervision by Accredited Agency,incomplete cadre structure of the Accredited Agency,blocked communication between the Accredited Agency and organs department office.It is found that these problems are caused by three aspects,the lack of correlative system,unclear understanding of the responsibilities and the hysteretic construction of cadre team.Finally,to solve these problems,this thesis proposes to straighten out Tiao-kuai relation,use the power correctly and enhance learning of the Grassroots Accredited Agency,to optimize staffing,strengthen contact,guidance and supervision and pay more attention to the Accredited Agency of the Grassroots Discipline Inspection and Supervisory Committee,to reduce Tiao-kuai confrontation and conspiracy of the Stationed Department,which aims to improve the system,strengthen the construction of cadre team and promote Tiao-kuai coordination and linkage for providing useful reference to optimize the Accredited Agency Reform for Grassroots Discipline Inspection and Supervision and improve the quality and effectiveness of the supervision by accredited agency.
