| Every oil spill from a ship will cause huge economic losses and serious pollution of the marine environment.Due to the flaws in the system of claims for cleaning costs,it is often difficult to pay for clean-up costs.If clean-up costs are not realized,the parties involved in clean-up up pollution will face tremendous pressure and are unwilling to participate in other cleaning activities.Will lead to the failure of timely removal of oil spills,resulting in economic losses and serious consequences of damage to the ecological environment.Therefore,it is important to study and analyze the related issues of clean-up cost claims and try to improve the clean-up cost claim system for my country’s marine economy and marine ecological environment.Excluding the introduction and conclusion,the article analyzes the different issues involved in the disputes of clean-up costs through five chapters:Chapter 1-An overview of pollution clean-up costs in ship oil pollution accidents.It mainly clarifies the concept of clean-up costs and distinguishes them from related concepts to prevent confusion,analyzes and discusses the international treaties and domestic and foreign legislation that my country has participated,to clarify the system of pollution clean-up costs.Chapter 2-The status quo of the judicial practice of clean-up costs in my country,which is a representative case of the "CMA CGM Florida",and summarized many problems in the clean-up costs.Chapter 3-The analysis of the subject of the claim for clean-up costs,the analysis of subject of responsibility for the clean-up costs and the subject of the right of the claim.Chapter 4-Focuses on the analysis of the method of claim for pollution cleaning expenses in ship oil pollution accidents,and analyzing the method by which the claim for cleaning expenses is more reasonable.Chapter 5-Put forward the conception of the compensation system for clean-up costs in our country,mainly for the claiming and responsible parties for clean-up costs,as well as the standardization of clean-up procedures and standards,and the supervision of clean-up behaviors. |
