Research On The Construction Path Of Government And Court Linkage In Enterprise Bankruptcy Reorganization Of Qinhuangdao City

Bankruptcy reorganization is an important means to regulate market entities to get out of difficulties,exit in an orderly manner or achieve recovery,and a sound government-court linkage work mode is an important guarantee for the success of restructuring,which is conducive to saving valuable distressed enterprises from crisis to safety,rebuilding the confidence of market entities,and playing an important role in creating a high-quality business environment and improving the social credit system.This paper takes the linkage between the government and the court in bankruptcy reorganization of Qinhuangdao City as the research object,discusses the existing problems of the government-court linkage in Qinhuangdao City,and puts forward sound countermeasures.This paper introduces the concepts of bankruptcy reorganization,government-court linkage,bankruptcy reorganization government-court linkage,as well as the theoretical basis of holistic governance theory,market failure theory,public interest control theory and other theoretical foundations,and explains the current situation of bankruptcy reorganization government-court linkage in Qinhuangdao,and understands the current situation and shortcomings of bankruptcy reorganization government-court linkage in Qinhuangdao City through interview investigation,literature research and comparative analysis.This paper conducts interviews and investigations with the bankruptcy administrators,key entities in bankruptcy reorganization cases,and analyzes the experience of bankruptcy reorganization cases in which he personally participates,showing that the linkage between the bankruptcy reorganization government and the court in Qinhuangdao City has problems such as imperfect supporting system,inaccurate government positioning,lack of special institutions,lack of data sharing,and low ability of bankruptcy administrators.In-depth analysis of the causes of the existing problems in the linkage between the government and the court in Qinhuangdao City’s bankruptcy reorganization,including imperfect supporting systems,weak subjective initiative in government work,insufficient capacity of bankruptcy administrators,and insufficient informatization support.Using the comparative analysis method,drawing on the experience of bankruptcy reorganization government-court linkage in advanced regions in China,this paper puts forward ways to strengthen the government-court linkage from five aspects,including establishing a scientific government-court linkage system,clarifying the boundary between judicial and administrative power,establishing a special institution,improving the bridging role of bankruptcy administrators,and establishing a bankruptcy reorganization government-court linkage management platform,which is of great significance for strengthening the government-court linkage construction in Qinhuangdao City and promoting the smooth progress of bankruptcy reorganization.
