| Public participation in legislation is a vivid practice of people’s democracy in the whole process.The most direct way is to thoroughly practice people’s democracy in the whole process by publishing the draft law to the public for comments.This is the development of participatory democracy in the field of legislation,as well as the extension and operation of consultative democracy in legislation.The principle of natural justice,the theory of people’s sovereignty,and the theory of consultative democracy,as the basic principles of the rule of soliciting opinions on bills,guide and continue to promote the practice of soliciting opinions on bills in China.Therefore,improving the public solicitation of opinions on bills is an important guarantee for protecting civil rights,realizing democratic legislation,and improving the quality of legislation.If the rule of law is prosperous,the country will be prosperous,and if the rule of law is strong,the country will be strong.To build a modern socialist country ruled by law with good law and good governance,we must adhere to scientific and democratic legislation,and need the joint efforts of the legislature and the public to achieve complementary cooperative legislation between the government and the public and the benign interaction between the state and society.Through to the National People’s Congress(NPC)and 31 provinces,autonomous regions and municipalities directly under the central government’s website analysis on bill for advice,sort out the current our country the main mode of public participation in legislation for advice,information disclosure scope,interactive feedback link,you can see our country public participation in legislative work,on the whole,has the good trend,but there are still some problems.There are mainly: first,the lack of public participation information.The information of public participation includes how the legislature publicly participates in the information,the degree of disclosure of the information content,and the opinions and feedback of the public after the participation.The specific manifestations are lack of diversification of information disclosure,incomplete disclosure of information content,and lack of public opinions and feedback information.Second,the form of public participation is flawed.The choice of the form of public participation determines the essential effect of public participation in a certain process.In the present stage,soliciting opinions for bills lacks unified standard participation platform and the participation way is not pluralistic and convenient.Third,there are limitations in individual public participation.The public themselves also have a weak awareness of participation,participation ability is insufficient,at the same time due to the influence of various factors to participate in the group imbalance.In view of the above problems in practice,this thesis puts forward suggestions for improvement,including: first,improve the supporting work mechanism of participating in legislation.The sound supporting working mechanism includes the information gathering mechanism of public opinions and suggestions,the adoption mechanism,the open mechanism and the feedback mechanism of two-way communication.Second,expand the ways of public participation.On the premise of ensuring the universality of participants,we should add diversified participation methods and improve the convenience of participation methods.Third,improve the interest expression mechanism of public participation.The effective expression of social public interests not only needs to enhance the awareness and ability of public participation,but also needs to establish an incentive mechanism for public participation in law solicitation,and give certain material and spiritual rewards to the participants. |
