In recent years,college sports injury accidents in Liaoning Province happen from time to time.If not properly handled,it will cause contradictions between students and colleges.Therefore,it is an important task for us to study the legal responsibility of dealing with sports injury accidents in order to solve the problems reasonably,legally and properly.Up to now,although much attention has been paid to the study of students’ injury incidents in our country,the research findings concerning sports injury incidents generally focus on minors,especially primary and middle school students.Therefore,it is of practical significance to study the application of law to college sports injury accidents.Based on literature,interview and case analysis,this paper discusses the legal relationship,the division of legal liability,the identification and the principles of legal liability,and sums up some deficiencies in the college sports injury accidents.(3)There are some problems in the handling of sports injury accidents in colleges and universities in Liaoning Province,such as the vague legal relationship between colleges and universities and students,the ambiguous application of the law in judicial practice,the imperfection of the rules of risk-taking and the lack of combination of sports theory and the handling of sports injury accidents in colleges and universities in Liaoning Province.Finally,this study combined with legal analysis of the practice of dealing with sports injuries in colleges and universities are still inadequate,combined with the characteristics of sports and experts to give recommendations for dealing with sports injuries in colleges and universities in Liaoning Province,the corresponding countermeasures and suggestions,including:(1)Improve the relevant laws and regulations.It includes,clarifying the legal relationship between schools and students,clarifying the principles of imputation applicable to sports injury accidents in colleges and universities,and clarifying the application of risk in sports injury accidents in colleges and universities;(2)improving the system of sports injury insurance in colleges and universities;(3)strengthening the risk prevention and management system of sports injury accidents in colleges and universities;(4)enhancing students’ selfprotection awareness;and(5)strengthening the professional ability of physical education teachers and the education of school safety. |
