Research On The Prevention And Control Of Computer Software Piracy Crime

In recent years,the rapid development of the Internet has brought great convenience to the society,but the problem of computer software piracy has consistently restricted the innovative development of the industry.China amended the criminal law in 1997 to stipulate the crime of infringement of copyright separately.The regulations on computer protection promulgated and implemented in 2002 clearly stipulates that the infringer will bear criminal responsibility if the infringement is serious.Bring computer software into the scope of criminal law protection.At present,computer software piracy crime is still in the high incidence stage.This paper takes50 typical cases of computer software piracy crime from 2016 to 2021 on the judgment document network and non litigation case network as the research object,uses the perspective of criminology,analyzes the criminal causes of computer software piracy crime from the perspectives of criminal economics and crime victim science,and puts forward prevention countermeasures,trying to control computer software piracy crime with an all-round and three-dimensional prevention and control system.Based on the concept of computer piracy and the characteristics of software piracy,the first part is divided into five parts.Put forward targeted prevention and control measures.The second part is the current situation of computer software piracy crime and the statistical analysis of typical cases.Through the statistical analysis of 50 cases,it is summarized from the aspects of the offender,the high incidence place of crime and the characteristics of crime: at present,the crime of computer software piracy is still in a high incidence situation,the crime is mainly joint crime,the crime is concentrated in economically developed areas,the crime cost is low and the income is huge.The third part,from the perspective of crime economics,clarifies the direct cost,indirect cost,punishment cost and follow-up cost of crime.The economic and psychological benefits of crime.And build a cost-benefit model to analyze the causes of crime from multiple angles.The fourth part analyzes the interaction mode between the victim and the perpetrator,the victim’s own victimization and the causes of victimization in the crime of computer software piracy.The last part puts forward the corresponding countermeasures according to the analysis conclusion: improve the efficiency of crime investigation and punishment,improve the penalty system,strengthen the social copyright awareness,so as to improve the cost of crime and reduce the income of crime.Reduce the victim’s own victimization and strengthen the right relief system after being killed.Improve relevant legislation and increase employment prohibition system and other measures.
