| The system for dealing with public complaints refers to the petitioning organ’s use of a wide range of legal,policy,administrative,and economic measures to educate and mediate petitioners as the primary means of achieving a joint work system of people’s mediation,administrative mediation,and judicial mediation.The system for handling public complaints is an innovative practice of practicing the "Fengqiao model" and is an important part of the comprehensive mechanism for the prevention,mediation,and resolution of social conflicts and disputes.At the moment,the system for handling public complaints is beset by issues such as a lack of rule of law,a lack of investigation and early warning functions,and a poor operational mechanism.In the context of a law-based government in all respects,all social systems must be based on the law and the law must be followed.As a new thing arising from the reform of the petition system,the Legal basis of the system for handling public complaints still needs to be improved.The system for handling public complaints has an investigation and early warning function that other dispute resolution methods lack,allowing it to nip conflicts and disputes in the bud.However,its investigation and early warning function is not well performed in practice,and the outstanding problems cannot be solved in advance.The ambiguity of the system and its inability to summarize cases cauze the poor operation in the practice of petition-resolving.To properly address the aforementioned issues,we must return to the original purpose of the establishment of the system for handling public complaints.We should assess the role and advantage of the system for dealing with public complaints in the joint work system for preventing and resolving contradictions and disputes.We should fully integrate the system for dealing with public complaints into the rule of law,explore and improve its operating procedures,and find a legal and reasonable route from acceptance to mediation to final settlement.Simultaneously,we must establish a joint work system that constantly integrates the system for handling public complaints with judicial,administrative,arbitration,and other mechanisms to encourage people to actively participate in social governance and to resolve internal conflicts among people at the grassroots level. |
