Appropriate Adult Present For Appropriate Inquiry

In recent years,with the continuous development of China’s economic level,social contradictions have also changed,and with the increase in juvenile delinquency rate,the protection of minors involved in cases has become the top priority in handling juvenile crime cases.However,due to their own psychological and physical characteristics,minors are often prone to fear and anxiety in the process of participating in criminal trial activities.Out of consideration for this situation,China has also been exploring the system that can best protect the legitimate rights and interests of minors involved in the case.Although the appropriate adult presence system has experienced a long period of development in China,there are still many problems,and the exploration of this problem in this paper is mainly combined with the current problems of the appropriate adult presence system in China.Through the theoretical analysis of the appropriate adult presence system,including the necessity and function of the appropriate adult presence system,and the comparison between the appropriate adult presence system and the existing different systems in China,the author lays a foundation for the analysis of how the appropriate adult presence system should be based on this part,and further system design is carried out.By summarizing the provisions of the appropriate adult presence system in China’s current legislation and the five pilot models of suitable adults that have been somewhat innovative in recent years,and conducting a unified analysis from the advantages and existing problems,and analyzing them one by one,the theoretical and practical foundation construction of how the appropriate adult presence system in China should be developed and improved is carried out.While improving the specific system,it responds to the problems in the specific work mentioned above,and improves the system in terms of involving specific subjects and procedures.At the same time,when constructing the appropriate adult presence system,the author proposes that the possible responsibility problems in the appropriate adult presence system should be corrected,and the creation puts forward the establishment of an exit mechanism for suitable adults in the specific trial process,and takes this as a major independent point for the improvement of the overall system of suitable adults.As a whole,a complete design of the appropriate adult presence system is formed through the design of subjects,procedures,responsibilities and appropriate adult exit mechanisms.
