Research On The Health Right Protection Of Subjects In Drug Clinical Trials In China

The safety of new drugs needs to be tested,and the smooth progress of trial activities is closely related to people’s health rights.At the same time,we should not ignore the rights and interests of subjects when conducting trials,and the health right of subjects should be protected.For the protection of health right of subjects in drug clinical trials,the following discussed:The first part is the theoretical analysis of the right of health of the subjects in drug clinical trials in China,focusing on the analysis of the particularity of the right of health,the difference between the subjects and others,the degree of protection of the nature of the right of health,the nature of the right of health and the responsibility of the subjects under different perspectives of legal protection.Finally,the discussion on the relationship between the subjects’ health and other rights,the right to health is closely related to other rights and has its own uniqueness.The second part discusses the necessity and feasibility of protecting the right to health of subjects in drug clinical trials,because of the conflict between the subjects and the trial in interests,the adverse events in drug clinical trials are increasing in recent years,subjects after damage may not get effective treatment and money compensation,the right to health is vulnerable during the course of the trial,to protect human rights,safeguard the health interests and health fair value,to protect the right of health of the subjects.The third part discusses the problems of protecting the health right of subjects in drug clinical trials in China,including legal norms,supervision,relief,etc,the current law is not perfect,the supervision of the test activities does not reach the designated position,the nonstandard behavior may also damage to the subjects’ right to health,and after the subject relief difficult problems.The fourth part is around the current problem suggestions,by perfecting the drug clinical trial subjects’ health right law,improve the supervision of drug clinical trials,establish adverse event early warning mechanism to regulate the test behavior,clear relief standard,establish compulsory insurance system,in order to provide better protection to the subjects’ right to health.
