Study On Antitrust Regulation Of Pricing Algorithm Collusion

With the advent of digital economy and artificial intelligence,the wide application of pricing algorithm technology has greatly changed the efficiency of market operation.Whether for operators or consumers,the pricing algorithm has shown certain technical advantages.For example,reducing production costs,promoting transactions and improving the overall operation efficiency of the market.However,it is undeniable that the pricing algorithm also has a negative impact on the market fair competition order,consumer rights and interests protection and other aspects.The intelligence of the pricing algorithm itself makes collusion easier.Specifically,pricing algorithm technology can not only be a tool to execute express collusion,but also can reach implicit collusion by analyzing market information to make autonomous decisions.Compared with traditional collusion,the introduction of pricing algorithm makes the participants of collusion more diverse,more stable structure system,more hidden form of expression and more intelligent meaning connection.This makes the pricing algorithm conspire to cause serious anti-competition effect and aggravate the damage to the legitimate rights and interests of consumers.At the same time,the use of pricing algorithm changes the market conditions of collusion,enhances the motivation of collusion subjects,and improves the stability of collusion maintenance,thus causing a huge impact on the traditional anti-monopoly law regulation theory.By analyzing the basic theory and the necessity of regulation,it is found that the regulation dilemma of pricing algorithm collusion is mainly embodied in the allocation of responsibility,the determination of subjective intention of operators and the difficulty of evidence collection by anti-monopoly law enforcement agencies.Based on this,under the development of the digital economy market in our country,combining with relevant national policies and referring to the experience of European and American countries in the regulation of pricing algorithm collusion,we can put forward some regulation suggestions from the following four aspects: First,optimize the regulation concept.Adhere to the market first,modest intervention;Secondly,make clear the allocation of responsibility of the conspirators of the pricing algorithm;Third,reasonable use of circumstantial evidence rules;Fourth,set up a perfect pricing algorithm supervision mechanism.Although there is no case of collusion of pricing algorithm,the pricing algorithm itself has attracted the attention of economics and computer circles.It is certain that pricing algorithm collusion is bound to become a hot and difficult issue for domestic and foreign anti-monopoly law enforcement agencies in the future.
