Research On Legal System Improvement Of China-Kazakhstan Renewable Energy Cooperation Under The Background Of "Carbon Neutrality"

Since the adoption of the Paris Agreement,members of the international community have made commitments to "carbon neutrality".China and Kazakhstan share the same goal of carbon neutrality,and cooperation on renewable energy is of great significance to achieving 2060 carbon neutrality on schedule.Since 2013,when the two countries established the initial vision of cooperation in the field of alternative energy,they have actively explored the possibility of cooperation in renewable energy and have reached numerous cooperation projects.The smooth development of the project cannot be separated from the guarantee of the legal system,but the existing legal system has exposed many deficiencies,and it is urgent to improve.Starting from the introduction of the basic theory of the legal system of China-Kazakhstan renewable energy cooperation under the background of carbon neutrality,this paper clarifies the relevant concepts of carbon neutrality,renewable energy and China-Kazakhstan renewable energy cooperation.It is analyzed that the improvement of the legal system of China-Kazakhstan renewable energy cooperation under the background of carbon neutrality is of great significance to deepening the bilateral renewable energy cooperation,protecting the interests of Chinese enterprises and realizing the goal of carbon neutrality in both countries.Secondly,by reviewing the current situation of domestic,bilateral and regional legal systems of China-Kazakhstan renewable energy cooperation in the context of carbon neutralization,it is found that there are problems of insufficient supply of technological innovation system and lack of applicable content outside the energy law in our domestic legal system.There are some problems in the bilateral legal system,such as the lack of a specific agreement to implement the joint declaration,the imperfect content of the agreement on encouraging and mutual protection of investment,and the inability of the existing scientific and technological cooperation agreements to effectively guide scientific and technological cooperation in renewable energy;There are some problems in the regional legal system,such as the lack of basic treaties in the energy field,the lag of financing system construction and the unsound dispute settlement mechanism.The main reasons are the lag of laws,the late start of China-Kazakhstan renewable energy cooperation,and the problem of interest coordination among member states has not been properly solved.The third,fourth and fifth parts mainly discuss the ways to solve the above problems.The improvement path of domestic legal system is to optimize the institutional supply of technological innovation and establish the relevant content of extraterritorial application of energy law.The way to improve the bilateral legal system is to sign the framework agreement on renewable energy cooperation,revise the agreement on encouraging and mutual Protection of investment and formulate the agreement on scientific and technological cooperation on renewable energy.The improvement path of regional legal system is to sign the basic treaty in the field of energy,enrich the related design of financing system and establish a scientific dispute settlement mechanism.
