Health issues concern everyone and involve their survival and development.Whether pursuing happiness or realizing personal life values,it is inseparable from the country’s protection and importance of health.As a social animal,the premise for humans to participate in collective activities is to exist as an independent individual.From birth to death,health issues have always been a fundamental right pursued by everyone throughout their lives.The health right,as a new type of right in the human rights system,is subordinate to one of the social rights relative to the right to freedom.Like most social rights,the theoretical "ideal" rights related to human rights protection are often considered lagging behind the scope of legal protection.The specific provisions of the health right are vague and abstract,lacking practical applicability and feasibility.Accompanied by issues such as medical health,environmental pollution,and disease transmission,social development has stagnated and continues to threaten human health.The issue of the health right has gradually received attention from various countries in recent years.The paper is divided into four parts:The first part is the basic theory of citizens’ health right.This includes three aspects: the connotation,nature,and characteristics of citizens’ health right,as well as the powers and ways in which citizens’ health right is embodied.It analyzes the relevant concepts of citizens’ health right.The second part discusses the basic issues of the national obligation of citizens’ health right.We discussed how to protect citizens’ health right from the perspectives of legislative,administrative,and judicial bodies,including various measures and methods at the legislative,law enforcement,and judicial litigation levels,in order to fulfill national obligations and safeguard citizens’ health right.It also explored the content of the national obligation of citizens’ health right,emphasizing that all citizens in the country are the subject of the health right,that citizens’ health right is the basis for fulfilling national obligations,and that the purpose of national obligations is to ensure the realization of rights.And examine typical countries where citizens’ health right obligations are fulfilled by the state.The third part is about the achievements and shortcomings of fulfilling the obligation of citizens’ health right in China.The achievements include the improvement and strengthening of legislative measures,the improvement of the basic medical insurance system,and the achievements in controlling major diseases.At the same time,the lack of fulfilling national obligations in China has been divided into two aspects to explore,namely the medical and health level and the legislative and regulatory level,as well as related issues such as the allocation of medical and health resources and imperfect legislation.The fourth part is the improvement measures and suggestions for the above shortcomings,which successively focus on optimizing the allocation of medical and health resources,improving the matching of medical and health resources,and emphasizing the psychological health status of citizens to improve medical and health deficiencies.The shortcomings in legal supervision are proposed by improving relevant legislation on citizens’ health right,improving the national regulatory system for citizens’ health right,and strengthening the importance of ecological civilization construction.The future development trend of citizens’ health right is multifaceted,including the continuous improvement of policies and regulations,the progress of medical technology,and the improvement of people’s health awareness.With the rapid development of China’s economy and society,as well as the intensification of population aging,the issue of citizen health is becoming increasingly prominent,and it is necessary to protect the right to citizen health.In this context,the national obligation of citizens’ health right was explored,and it was explained in detail that the national obligation is the foundation for ensuring the realization of citizens’ health right.The implementation methods and specific measures of citizens’ health right under the national obligation were elaborated,and corresponding solutions and suggestions were proposed to address the current problems.At the same time,the concepts of the content of the health right and the justiciability of the health right,especially regarding the national obligations of the health right,have considerable exploration value.
