The Lenient Sentence For The Crime Of Buying Trafficked Women And Children And Its Governance Ideas

Statistics from 277 judgments made public from 2019 to 2022 reveal that the crime of buying trafficked women and children has a high proportion of non-punishment and probation for those responsible for the purchase of 87%,with an absolute majority of sentences of less than one year in prison.The reasons for the lenient sentences are concentrated in the imperfect legislation,insufficient understanding of the legal benefits of the crime of buying trafficked women and children,narrow local protectionism,the backward concept that the law is not responsible for all,and many other comprehensive factors.To deal with the problem of lenient sentences,we should optimize the structure of crimes and penalties,reconfigure the penalties,accurately interpret the legal benefits of the crime of buying trafficked women and children,and at the same time improve the relevant procedures of criminal proceedings,prevent the abuse of trial power,and strengthen the promotion of the rule of law to combat the crime of buying trafficked women and children.
