Research On The Legal Issues Of Network Virtual Property Inheritance System

As the Internet flourishes,its changes and benefits can be felt in every field around us,bearing the burden of being our indispensable link to the virtual world.In this virtual world,the first thing we feel is the value it brings,such as the various kinds of virtual property we have on the Internet.While seeing its value,more and more people begin to pay attention to whether these network virtual property can be inherited,and the practice has gradually produced related inheritance disputes.However,in China’s Civil Code and its Internet laws and regulations,a complete protection system has not been formed for the protection and inheritance of network virtual property,for example,the general chapter of the Civil Code only provides for the protection of data and network virtual property in principle;In the inheritance section of the Civil Code,it is vaguely acknowledged that it belongs to the scope of inheritance,but the inheritance rules and other related rules are still in the theoretical research stage,and there is no relevant law to stipulate.After understanding this background,the author believes that it is very important for the judicial practice and every citizen to clarify the relevant inheritance system,so I choose this paper topic for research.This paper will discuss one by one from the following aspects.The introduction briefly introduces the background and significance of the legal issues studied in this paper,and summarizes the domestic and foreign legal provisions and scholars’ views on the succession issue.The first chapter describes the network virtual property.Through the introduction of cases to raise questions,and the relevant concepts,characteristics and types to be clear.The second chapter elaborates the logical premise of network virtual property inheritance.Firstly,the inheritability of network virtual property is clarified,and then the domestic scholars on the legal nature of the research is analyzed.Finally,the difference between it and traditional property inheritance is clarified.The third chapter shows the status quo and questions of the network virtual property inheritance system.According to the demand of theory and practice,it is found that there are mainly problems such as lack of legal basis,unknown inheritance subject,lack of inheritance procedure and difficult problems in litigation.The fourth chapter investigates the virtual property inheritance system of the overseas network.This paper analyzes the legal regulation and advanced experience of the countries where this kind of dispute appeared earlier.The fifth chapter puts forward some suggestions to perfect our network virtual property inheritance system.In the construction of the relevant system,combined with the legislative experience of foreign countries,put forward their own opinions.By perfecting the legal provisions of the network virtual property inheritance system,clarifying the scope of inheritance subjects,constructing inheritance procedure rules,perfecting litigation procedures and constructing auxiliary systems,we can solve some legal dilemmas existing in the current theory and practice.
