Judicial Determination Of The Actual Constructor’s Project Price ’Priority Compensation’

The identification of the actual construction person ’s project price in the construction project exists in judicial practice.This article starts from the case of ’ Zheng v.A construction company,etc.’,combined with the understanding of relevant laws and regulations and their judicial interpretations,three legal issues are sorted out : 1.The scope of the subject of the priority of the project price;2.Whether the ’ distribution plan ’ dealing with priority claims is legal;3.Whether the contractor can transfer the priority compensation price of the project to the actual constructor.Through the analysis,it can be seen that the actual constructor in this case has the creditor ’s right confirmed by the legal effective document,but the execution name does not specify that the creditor ’s right is the priority,so the ’ distribution plan ’ directly allocates the priority creditor ’s right to the actual constructor is improper;third,the actual constructor obtains ordinary creditor ’s rights through Article 43 of the " Construction Judicial Interpretation I," and the subject of the priority right to compensation for the construction project price does not include the actual constructor;the priority right to repayment of construction project price can be transferred with the main creditor ’s right,but it should conform to certain procedures.In this case,the actual constructor did not obtain the priority right to repayment by virtue of the legal and effective project creditor ’s right transfer contract.Therefore,Zheng ’s objection to the implementation of the distribution plan on the three actual constructors ’ priority compensation for the project funds should be supported.Then,based on the above judgment of the case,this paper puts forward the thinking of the application of the actual constructor in the priority compensation system and the suggestion of establishing the priority compensate registration system.
