Research On The Approximate Identification Of Trademarks

The approximate identification of trademark plays an important role in the theory and practice of trademark in our country.The correct understanding of the concept of trademark approximation,the perfection of the standard of trademark approximation identification,the improvement of the method of trademark approximation identification,the accurate grasp of various situations of trademark approximation identification,related to the sound and effective implementation of the trademark legal system.This article is divided into four parts.The first part is the summary of the approximate identification of trademark,mainly discusses the concept of trademark approximation and its relationship with the possibility of trademark confusion,trademark infringement and confusion,and to the trademark approximate cognizance question forms the preliminary understanding.The second part is about the standard of approximate identification of trademark,mainly discussing the understanding of the standard of approximate identification of trademark and the development of the standard of approximate identification of trademark in our country,at the present stage,the mainstream standard of trademark approximation and the contradiction between the standard of trademark approximation and the trademark law are put forward.The third part is about the methods of trademark approximate identification,mainly discussing the general requirements of trademark approximate identification,and discussing the methods of isolated observation,whole comparison and essential part comparison in detail,this paper analyzes the factors that affect the approximate determination of trademarks,such as the degree of approximation of trademarks,the general attention of the public,etc..The fourth part is about the approximate identification of special trademark,mainly discussing the approximate identification of foreign trademark,archaic trademark,graphic trademark and combination trademark.Through the research,the author hopes to have a correct understanding of the concept of trademark approximation,perfect the criteria of trademark approximation identification,optimize the methods of trademark approximation identification,and accurately identify trademarks under various circumstances,for the trademark approximate determination of the theory and practice of development of a modest force.
