Family is the smallest unit in the society,and in the new era,family education is gradually added into the social governance.The Family Education Promotion Law of 2022 was introduced so that ordinary families could also receive country’s help.Even though child protection and juvenile delinquency prevention had gradually improved in recent years,studies had shown that problems such as juvenile delinquency were closely related to inadequate family education in practice,moreover,theoretical research on family education guidance generally starts from the perspective of the education system,but rarely from the perspective of the legal system.Therefore,it has become an important task for all sectors of society to further improve the legal system of family education guidance and parental guidance in family education,help children grow up healthily,improve family happiness and social harmony."In view of this,the article takes the legal system of family education guidance as the research object,enriches and expands the theoretical research on improving family education guidance,further explores the development status and improvement paths of the legal system of family education guidance,in order to guide parents to implement family education more efficiently and correctly,and to ensure the healthy growth of minors from all aspects and perspectives throughout the process,Provide reference for the further development of the legal system for guiding family education in the future.Besides the introductory phrase and summarizing Paragraph,this thesis is segmented with four parts.The first part outlines the family education and family education guidance’s concept in China,identifies family education guidance’s objects and subjects,and analyzes the three legal bases of family education guidance-the theory of limited intervention,the theory of guardianship status and the theory of proportionality,in order to promote the understanding of the new implications of family education guidance and prepare the ground for the later discussion.The second part analyzes the present status of the family education guidance’s legal system in China,describes the current status of the existing national and local legal regulations of family education guidance,the implementation and the guarantee support in China,and analyzes the shortcomings of it through three parts: Imperfect legislation,Inadequate implementation and supporting measures faultiness of Family Education guidance in China.The third part introduces foreign studies on the family education guidance’s legal system and summarizes the three representative models of the legal systems of family education guidance abroad: state-led,community-led and community organization-integrated.Then analyzes how foreign family-oriented legal systems inspire China.The fourth part says the suggestions.First,there is a need to improve family education guidance legislation,further improve legislation at the national and local level;second,there is a need to guarantee the implementation of family education guidance laws in China,improve coordination among various subjects,and unify the application of laws by judicial organs;finally,there is a need to improve the guarantee to support the legal system of family education guidance in China and improve family education guidance legislation.Finally,it is necessary to improve the support measures for the family education guidance’s legal system in China,integrate the support resources,and establish the supervision and evaluation mechanism.
