| The global digital transformation is accelerating and China’s information and communication industry is developing rapidly,and it plays an important role in promoting the high-quality development of the digital economy and improving the quality of people’s lives.At the same time it can also lead to corresponding problems due to a mismatch between the speed of development and the development of sound protection measures.In the digital age,all information and services that we access can gradually be done through information networks.The absence of offline identity authentication dictates that access to services requires the transformation of personal information into electronic data for circulation in the information and communication industry,and the resulting security risks of personal information have attracted a great deal of attention and concern from the state and individuals.The provisions of the Civil Code of the People’s Republic of China(hereinafter referred to as the "Civil Code")and the Law of the People’s Republic of China on the Protection of Personal Information(hereinafter referred to as the "Personal Protection Law")regarding the system of notification of consent have provided certain safeguards for the protection of personal information,and while further strengthening the protection of personal information,they have also given rise to many practical issues and unresolved discussions.The "consent" system is the "informed consent" system,also known as the "informed consent" system.The "informed consent" system was established in the Civil Code and further improved in the Personal Protection Code.However,since its implementation,the focus and difficulties that have arisen in practice have also come to the fore.This article focuses on the "consent" system in the protection of personal information and discusses the specific meaning of the "notification of consent system",its theoretical basis,as well as the obstacles faced by this system in the process of personal information protection,the practical problems that have arisen and the countermeasures to solve them.In order to improve the quality of services in the information and communication industry while protecting personal information,the efficiency and quality of the services provided by enterprises will be improved while personal information is adequately protected,so that efficient information network services will not be reduced because of the protection of personal information.This requires the cooperation and efforts of the information subject,the information processor and the department responsible for the protection of personal information,so that the relationship between the three parties can be balanced,and play a mutually supportive and supervisory role,eliminating various obstacles to the notification of consent system in practice,and establishing a safe and efficient network service environment. |
