Research On International Protection Of The Rights Of Internally Displaced Persons

While both internally displaced persons and refugees enjoy the human rights enshrined in international human rights treaties and are forced to leave their homes for fear of violations of their lives,freedoms and security,internally displaced persons do not enjoy the same systematic and specialized international protection as refugees.The importance and urgency of the protection of the human rights of internally displaced persons has been highlighted in recent years,as the problem of internal displacement has become increasingly acute worldwide,it is urgent for the international community to provide systematic and specialized international protection for them.Analysing the current state of international protection of the rights of internally displaced persons by studying the provisions of international law relating to internal displacement,current gaps in the international protection of the rights of internally displaced persons can be found at the legislative,law enforcement and judicial levels.At the level of legislative protection,there is no legal basis for the protection and assistance of the international community in the absence of laws specifically protecting them,and at the level of law enforcement protection,in the absence of the active cooperation of the states concerned,inadequate protection and inadequate methods of protection by international organizations and,at the level of judicial protection,the crimes of forcible transfer or expulsion of civilians due to the inadequacy of the judicial system of the International Criminal Court and political interference by states,impunity often prevails.This means that the existing international legal regime for the protection of internally displaced persons is no longer adequate to deal with the increasingly complex protection of internally displaced persons.In order to effectively protect the rights of internally displaced persons,the international legal system for the protection of internally displaced persons should be improved to provide a legal basis for their protection and assistance.Secondly,there is a need to establish a framework for state responsibility so that states have the obligation and capacity to cooperate with the work of international organizations,to raise the level of protection of international organizations and to establish a protection approach that covers the entire process of displacement.Lastly,there was a need to improve the judicial system of the International Criminal Court and reduce state political interference in order to put an end to impunity.The concept of a community of shared future for Humanity is closely linked to the international regime for the protection of internally displaced persons and can provide theoretical guidance for the protection of internally displaced persons.Under its guidance,China should actively promote the international legislative protection of internally displaced persons,actively participate in the international law enforcement protection of internally displaced persons,and actively promote the international judicial protection of internally displaced persons.
