With the development of science and technology,artificial intelligence and its core algorithms are being embedded in many social,economic and political fields with unprecedented depth and breadth,and an unprecedented highly automated world is taking shape.With its unique mode of operation,artificial intelligence algorithms have completely overturned traditional lifestyles and habits,and have triggered a series of ethical crises.How to ensure technology for good is not only a question of ethics,but also of the rule of law.How to rationally examine algorithm technology in the context of the rule of law and how to effectively regulate algorithms is an important issue of international concern in the era of artificial intelligence.For China,providing more legal and policy support for AI technology and regulating algorithms will determine whether China can achieve a multi-win situation for technology and industrial development in the new round of technological and industrial revolution.In order to discuss how to regulate algorithms,we need to understand algorithms and their applications,and use the rule of law thinking and rule of law to discuss and seek countermeasures to improve the legal regulation of artificial intelligence algorithms.This paper focuses on an overview of AI algorithms,the ethical risks of AI algorithms and their typical manifestations,the current situation and shortcomings of China’s legal regulation of AI algorithms,and finally proposes recommendations for improving the legal regulation of AI algorithms.The first part of the article explores four characteristics of AI algorithms:underlying generality,external data dependency,output uncertainty,opacity,and its embedding logic,and efficiency-driven logic.The second part of the article focuses on the definition of the concept of ethical risks of AI algorithms and typical scenarios of ethical crisis.The precise marketing of e-commerce platforms makes it possible to "kill the ripe old" with big data.The need for coordination between autonomous driving and the current system of traffic laws and regulations.When artificial intelligence intervenes in judicial decisions,the subjectivity of the judge must still be upheld.If medical AI does not guarantee the safety and accuracy of its algorithms,it will lead to a crisis of trust.In the financial sector,AI will have a profound impact on finance,which is at the top end of the service value chain.The third part of the article focuses on the current situation of China’s legal regulation of AI algorithms and its shortcomings.Firstly,the article analyses the current situation of legal regulation of AI algorithms in China.Secondly,the article analyses the shortcomings of China’s legal regulation of AI algorithms,mainly including the controversial qualification of AI legal subjects leading to the problem of liability,the difficulty of implementing transparency issues,and the lagging nature of the law itself.The fourth part of the article puts forward corresponding suggestions for improving the legal regulation of AI algorithms.Firstly,in the face of disputes over the eligibility of AI legal subjects leading to liability problems,law guides AI algorithmic subjects to self-regulate.Secondly,in the face of the dilemma that transparency issues are difficult to implement,we need to accelerate the top-level design of transparency governance for AI algorithms.Thirdly,in the face of the problem of the lagging nature of the law itself,the problem will be solved by establishing an AI algorithm impact assessment system,constructing a multi-party participation governance model for AI algorithms,and exploring the path of AI algorithm infringement public interest litigation.
