Legal Protection Of The Rights Of Digital Vulnerable Groups

The digital vulnerable group means that in the digital age,due to the economic poverty and lack of capacity of the subject,coupled with the rapid development of digital science and technology,the unbalanced spread and the disadvantages of the digital economy,it leads to the weak position in the enjoyment of digital resources,digital dividends and legal rights,such as marginal status,weakening rights and vulnerable groups.Based on the different influence of digitization on different groups,this paper thinks that it is necessary to classify the digital vulnerable groups into dominant digital vulnerable groups and recessive digital vulnerable groups.Different types of digital vulnerable groups have differences in the scope of subjects and specific causes,but they have something in common in the types of rights infringed,including equality,labor,privacy,personal information and personal data.In addition,in terms of security difficulties,the dominant digital vulnerable groups are deficient in the rule of law system,and there are also deficiencies in improving digital literacy and strengthening public services.The recessive digital vulnerable groups are manifested in the limitations of the "inform-consent" rule and administrative supervision,as well as the lack of regulation of the algorithms on which the digital society depends.In order to better protect the rights of digital vulnerable groups and let them develop healthily in the digital society,we should establish the principles of equal protection and preferential protection,the principle of human rights protection and the principle of co-building,co-governance and sharing.At the same time,for the dominant digital vulnerable groups,we should not only update the legislation,improve the judiciary,strengthen the popularization of the law,and give full play to the combined force of the three,but also pay equal attention to improving digital literacy and strengthening public services.for the recessive digital vulnerable groups,we should not only give play to the public law binding force of administrative supervision,but also bring the algorithm into the category of legal governance.
