Research On The Management Of Judicial Appraisal In Huaihua City

Judicial expertise exists widely in our daily life.The fairness,justice and scientificity of its appraisal results directly affect the fundamental interests of the people,and it is the direct embodiment of the credibility of forensic expertise.In the management of judicial appraisal in China,the technical provider is the relevant appraisal institution,and the public service provider is the judicial administrative department.A fair and just appraisal conclusion can not only actively safeguard citizens’ rights,promote the improvement of relevant social fairness,but also promote the smooth development of judicial activities,and promote the social development towards fairness and justice.The promulgation of the 2005 Decision of the Standing Committee of the National People’s Congress on the Management of Judicial Appraisal guaranteed the management of the appraisal work from the legislative level and entrusted its administrative responsibilities to the judicial administrative organs.On the whole,the development of judicial appraisal management in China is in line with China’s basic national conditions and conforms to the socialist rule of law with Chinese characteristics,but there are still imperfections.The last five years of judicial expertise management data of Huaihua city was obtained through the literature reference,field visits to Huaihua judicial administrative department,judicial appraisal institutions,bureau of public security,people’s procuratorate,people’s court and other relevant departments,and interview with relevant personnel.After careful sorting and accurate analysis of the data collected,the author found management vulnerabilities existing including the unified management has not been in place,lack of the "four categories" management,ignore judicial expertise management,unreasonable resource allocation of judicial authentication institutions,insufficient management of the practice process of judicial authentication institutions,insufficient play of the industry management role of the judicial authentication association.After comparative research such as in-depth analysis of causes,draw lessons from advanced experience at home and abroad,and combining with the characteristics of Huaihua city’s conditions,the author put forward to a series of possible attempts from the perspectives of management subject,management object and management content.Suggestions and construction methods include establish a unified management system,improve the "four categories" management,strengthen judicial appraisal talent management,improve the appraisal institution resource allocation,strengthen the management of appraisal institution practice,give full play to the role of association industry management countermeasures.This study is of great practical significance for promoting the long-term and orderly development of judicial identification in Huaihua,improving the social recognition of judicial identification,and promoting the construction of the rule of law in Huaihua.In addition,it can also provide some enlightenment for other regions to strengthen the management of judicial identification.
