The advent of the era of big data makes people make more full use of personal information.At the same time,the invention of biometric technology makes biometric information can be repeatedly used.The development of technology and the wide dissemination of information,on the one hand,convenient people’s life,on the other hand,it also brings challenges.The contradiction between biometric information protection and utilization is increasingly prominent."The first case of face recognition" started the war of biometric information protection,for the protection of biometric information is urgent,At present our country has introduced the protection law of Personal information and has made some responses to the protection of biometric information,although there remains the crime of violating citizens’ personal information in our criminal law,but the crime for the biometric information is not defined,there is no biometric information protection of specific provisions,so this article will focus on how to use criminal means to protect biometric information.This article is divided into four parts.The first part is the introduction,which introduces the scientific background of biometric information and the research status at home and abroad,explaining the research methods;The second part is to summarize the problems facing the criminal protection of biometric information in China,The first problem is the lack of biometric information about the crime of breaching citizens’ personal data,The second dilemma is about the imperfect situation of criminal law protection of biometric technology accompanied by biometric information;The third part is the demonstration of the inclined criminal regulation of biometric information,That is why to emphasize the protection of biometric information;The fourth part is some suggested measures to overcome the protection of biometric criminal law.Criminal law for the protection of biometric information to measure good information utilization and information security scale,need to follow the principle of unity and criminal law modesty,to effectively prevent risks,and not excessive interference personal freedom of biometric information,do good order of effective regulators for personal biometric information by reasonable protection,promote the information use of benign circulation,so can play a role of criminal law for social maintenance and security.
